General Terms and Conditions

Article 1 – Definitions

In these terms and conditions, the following definitions apply:

Cooling-off period: The period during which the consumer can exercise their right of withdrawal.

Consumer: A natural person who is not acting in the course of business or profession and enters into a distance agreement with the entrepreneur.

Day: Calendar day.

Duration transaction: A distance agreement relating to a series of products and/or services, where the delivery and/or provision obligations are spread over time.

Durable medium: Any medium that allows the consumer or entrepreneur to store information addressed to them personally in a way that enables future consultation and unchanged reproduction of the stored information.

Right of withdrawal: The right for the consumer to cancel the distance agreement within the cooling-off period.

Entrepreneur: The natural or legal person offering products and/or services remotely to consumers.

Distance agreement: An agreement where, within the framework of a system organized by the entrepreneur for distance selling of products and/or services, only remote communication techniques are used up to and including the conclusion of the agreement.

Remote communication technique: A method that can be used to conclude an agreement, without the consumer and entrepreneur being in the same place at the same time.

General Terms and Conditions: These General Terms and Conditions of the entrepreneur.

These terms and conditions apply to all offers made by the entrepreneur and to all distance agreements and orders between the entrepreneur and the consumer.

Before the distance agreement is concluded, the text of these terms and conditions will be made available to the consumer. If this is not reasonably possible, the entrepreneur will inform the consumer that the terms and conditions are available for review, and that they will be sent to the consumer free of charge upon request.

In the case of electronic agreements, and if it is not possible to make these terms available directly, the entrepreneur must inform the consumer where they can find the terms and conditions electronically, and that they will be sent free of charge upon request.

If specific product or service conditions apply in addition to these terms, the second and third paragraphs will apply accordingly, and the consumer may rely.


Article 3 – Applicability

These terms and conditions apply to every offer made by the entrepreneur and to every agreement concluded between the entrepreneur and the consumer.

Before the agreement is concluded, the consumer will be provided with the terms and conditions, and by entering into the agreement, they accept these terms.

In the case of distance agreements, the consumer will be informed of their right to cancel the agreement, in addition to the other rights granted under these terms.


Article 4 – Conclusion of the Agreement

  1. The agreement is concluded when the consumer accepts the offer of the entrepreneur.

  2. The entrepreneur will confirm receipt of the consumer's acceptance via email or another durable medium without delay.


Article 5 – Right of Withdrawal

  1. The consumer has the right to cancel the agreement within 14 days without giving any reason.

  2. The cooling-off period will expire 14 days after the day on which the consumer acquires physical possession of the product.

  3. To exercise the right of withdrawal, the consumer must inform the entrepreneur of their decision to cancel the agreement by sending a clear statement (e.g., by email).


Article 6 – Obligations of the Entrepreneur in the Event of Withdrawal

  1. If the consumer cancels the agreement, the entrepreneur will reimburse all payments, including delivery costs, within 14 days of receiving the cancellation notice.

  2. The entrepreneur will use the same payment method for the refund unless the consumer has expressly agreed otherwise.


Article 7 – Exclusion of the Right of Withdrawal

  1. The right of withdrawal is excluded for:

    • Products that have been customized or made to the consumer's specifications.

    • Sealed products that are not suitable for return for reasons of health protection or hygiene.


Article 8 – Delivery and Execution

  1. The entrepreneur will deliver the goods to the address provided by the consumer.

  2. The entrepreneur will execute the agreement with reasonable care and within the agreed timeframe.


Article 9 – Pricing

  1. All prices for products or services are inclusive of GST.

  2. Prices are subject to change, but the price at the time of purchase will apply.


Article 10 – Payment Terms

  1. The consumer agrees to pay the price indicated in the order confirmation.

  2. Payments must be made using the methods indicated on the entrepreneur's website.


Article 11 – Warranty and Conformity

  1. The entrepreneur guarantees that the products comply with the contract, the offer, and the statutory requirements.

  2. In case of defects, the consumer may request a repair or replacement.


Article 12 – Liability

  1. The entrepreneur is not liable for damages caused by misuse or failure to follow product instructions.

  2. The entrepreneur's liability is limited to the amount of the order.


Article 13 – Dispute Resolution

  1. In case of a dispute, the consumer should first contact the entrepreneur to attempt to resolve the issue.

  2. If the dispute cannot be resolved amicably, the consumer may submit the matter to the competent court.


Article 14 – Privacy and Data Protection

  1. The entrepreneur respects the consumer's privacy and ensures the security of personal data.

  2. The entrepreneur will process personal data in accordance with the privacy policy.


Article 15 – Force Majeure

  1. The entrepreneur is not liable for failure to fulfill their obligations due to unforeseen circumstances beyond their control, such as natural disasters or strikes.


Article 16 – Governing Law and Jurisdiction

  1. These terms and conditions are governed by the laws of Australia.

  2. Any disputes will be submitted to the courts of Australia.
